What is the Acceptable Use Policy?

"Need A Dot Com?" (NADC) provides Internet Domain Name Registration, World Wide Web page hosting and Electronic Mail services.

NADC's general policy is to act as a neutral provider of hosting services to the global Internet. NADC reserves the right to suspend or cancel a customer's access to any or all services provided by NADC when NADC decides that the account has been inappropriately used, as solely determined by NADC.

 Payment Policies
All pricing is guaranteed for the term of payment received. No account is activated until payment is received. Payments for Domain Names must be paid by credit card. Other services may be paid by check, money order or credit card. Credit Card payments are billed automatically each term. Payments by check or money order require prior approval, are billed in quarterly cycles, and incur a $2.50 handling surcharge per invoice. Any payments returned unpaid (NSF) will be assessed a $25 charge.

All payments are due upon invoice, payable in US dollars. Should payment in full of any invoice not be received by NADC within thirty (30) days after activation or renewal, NADC may impose a debt service charge amounting to one and one-half percent (1.5%) of the overdue balance (or such lesser amount as may be required by law) for each month or fraction there of the overdue amount remains unpaid. In the event that any amount remains unpaid thirty (30) days after presentation of invoice, NADC may withhold or suspend services. Reconnection of suspended services may result in additional setup fees.

 30 Day Money Back Guarantee!
Your happiness is our happiness! Every new NADC web hosting plans carries a 30 day money back guarantee. If you are not completely satisfied with our services within the first 30 days of account creation, you will be given a full refund of the contract amount (excluding domain registration and any setup fees). Once paid, new domain name registrations are irreversible; We cannot give refunds for any domain registration fees.

Setup fees are refundable for the following reasons only: (1) the account order is canceled prior to activation; or (2) the domain name was not available at the InterNIC.

Contracts are based on the term paid (monthly, yearly, etc.) as specified at registration, or renewal. The full contract amount less any setup fees will be refunded if NADC is notified within the first 30 days following initial activation. No refund is available after the 30th day.

 Server Use
Web sites are to be used by the primary domain owner only. Customers are not permitted to resell (or give away) web hosting services off of their web site to other parties. Web hosting services are allowing a separate, third party to host content on your web. Exceptions to this include ad banners, classified ads, and personal ads. We may grant other exceptions to this policy, but you should check to see if your intended use is acceptable. We have reseller programs available; interested parties should also contact us. NADC reserves the right to refuse service and/or access to its servers to anyone. NADC expressly forbids any server use for distribution, storing, processing, or otherwise handling in any way the following:

Unauthorized Commercial files - This includes copyrighted works (such as mp3 music files, etc.), and any material in violation of any Federal, State or Local regulation.
Adult material - Includes all pornography, profanity, erotic images, or otherwise lewd or obscene content. The designation of 'adult material' is left entirely to the discretion of NADC.
Warez, et. al. - Includes phreaking, hacking, password cracking, IP spoofing, etc... and any sites which provide 'links to' or 'how to' information about such material.
Spam & UCE - This includes sending unsolicited junk mail through our mail servers, and/or referencing any content hosted on our servers in a spam email message or spam newsgroup posting.
Violation of these server use policies will result in immediate account suspension and/or termination. There are no refunds for any account terminated for violating server use policies.

 Unlimited Use Plans
Our goal for these accounts is to ensure each and every customer the freedom to build and grow their website without having to worry over usage restrictions and usage surcharges. Of course, common sense rules need to apply to prevent abuse of this system.

Since 1996, NADC has successfully offered an unlimited use policy by maintaining very large ratios of bandwidth and disk space per customer. In extremely rare cases, we may find a customer using server resources to an extent that they jeopardize server performance and resources for other customers. Therefore, we do not permit any sites that use more than 10% of system resources, or sites which in our sole discretion are detrimental to the enjoyment of our services by our other clients, or are detrimental to our network or business operations. In such instances, we reserve the right (on a case-by-case basis) to require subscription to higher-end and/or dedicated server resources as necessary for the consideration of all customers.

Unlimited use for web hosting should be for a single domain, with all content in that domain related directly to and linkable from your web. "Disk Storage" uses, such as archiving email, software or other high volume file collections (i.e. sound, music, videos, photos, etc.) and/or creating backup webs on our servers are not permitted. Specifically, we do not permit sites in the Unlimited Plan where 20% or more of the monthly traffic is from file downloads. Websites that have a focus of maintaining extremely large file archives will be asked to limit file storage to under 500MB. Email storage is limited to 15MB per POP account. Any email stored over 120 days on our servers may be removed without notice.
